Terms of Service

These Terms govern your use of the SmartQ mobile application and related services (the “App”) provided by Smart Data Analytics. By using the App you agree to these Terms.

1. The service

SmartQ is a field data-collection platform that lets organizations (“Clients”) create surveys and have authorized staff (“Users”) collect responses, including offline, with GPS verification.

2. Accounts and devices

• Access is granted by a Client administrator. Users enrol a device, which must be approved before full functionality is available.
• You are responsible for keeping your credentials and device secure.
• The Client may revoke your access at any time.

3. Acceptable use

• Use the App only for legitimate data collection authorized by your Client.
• Do not attempt to access data belonging to other Clients.
• Do not reverse-engineer, disrupt, or misuse the service.
• Collect personal data only with appropriate consent and in line with applicable law.

4. Data ownership

Survey data belongs to the Client that collected it. Smart Data Analytics processes that data on the Client’s behalf to operate the service, as described in the Privacy Policy.

5. Availability

We aim for high availability but do not guarantee uninterrupted service. The App supports offline use; data queued offline syncs when connectivity returns.

6. Disclaimer & liability

The App is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Smart Data Analytics is not liable for indirect or consequential damages arising from use of the App.

7. Termination

We may suspend or terminate access for breach of these Terms or at a Client’s request.

8. Governing law

These Terms are governed by the laws of the Republic of Serbia, unless otherwise required by your local law.
